Telehealth Consent

This is a general telehealth informed-consent notice and may be supplemented by state-specific language. Please read it carefully before using the Service. Where your state requires additional or different consent terms, those terms apply.

By using Vitale Health (the “Service”), you consent to receive medical services via telehealth, including asynchronous (store-and-forward) telehealth in which a licensed clinician reviews the health information you submit and makes clinical decisions without a real-time visit. Depending on your state and clinical circumstances, your care may also include live video or telephone communication. This consent explains the nature of telehealth, its benefits and limitations, and your rights.

What telehealth is

Telehealth is the delivery of health care services using electronic communications and information technology rather than an in-person visit. Through the Service, you provide a medical history and intake information that a licensed clinician reviews to determine whether treatment is appropriate and, where appropriate, to issue a prescription. Your clinician will be licensed in the state where you are located at the time of service.

Benefits

  • Convenient access to a licensed clinician without travel or scheduling an office visit;
  • Timely review of your health information;
  • Confidential handling of your information consistent with applicable privacy laws.

Limitations and risks

You understand and accept that:

  • No in-person physical examination will be performed;
  • The clinician relies on the information you provide, so inaccurate or incomplete information may lead to an incorrect assessment, an inappropriate treatment, or treatment being declined;
  • Not every condition is appropriate for telehealth evaluation, and the clinician may determine that you should be seen in person;
  • As with any medical service, there are potential risks, including that a condition may not be diagnosed, that a treatment may not produce the expected result, or that side effects or adverse reactions may occur;
  • Technical failures, delays, or security issues could, in rare cases, affect the transmission or timing of your care.

Alternatives

You have the right to receive care through traditional, in-person methods instead of telehealth, and you may seek a second opinion or in-person evaluation at any time. Your clinician will tell you if they believe in-person care is more appropriate for your situation.

No guarantee of treatment

Completing an intake and paying any applicable fee does not guarantee that you will be prescribed any product. The clinician may decline to prescribe if treatment is not clinically appropriate. Refund terms for the telehealth visit fee are described in our Refund & Shipping Policy.

Follow-up and continuity of care

Telehealth through the Service supports ongoing care, including follow-up messaging and periodic check-ins. You are responsible for attending recommended follow-ups, sharing relevant updates with your clinician, and informing your other health care providers about treatments you receive through the Service so your overall care can be coordinated.

Privacy, records, and recording

The information disclosed during your use of the Service is protected under applicable federal and state privacy laws, as described in our Privacy Policy. Your interactions may be documented in your medical record. We do not permit you or any clinician to record a telehealth interaction without the other party's consent. You have the right to request copies of your records.

Not for emergencies

Telehealth through the Service is not appropriate for medical emergencies. If you are experiencing an emergency, call 911 or go to the nearest emergency room immediately.

Your rights

Your participation in telehealth is voluntary. You have the right to decline telehealth and to seek in-person care instead, to ask questions about your care, to refuse any recommended treatment, and to file a complaint with us or with your state medical or pharmacy board. You will not be retaliated against for raising a concern.

Consent and withdrawal

By using the Service, you acknowledge that you have read and understood this consent, that you have had the opportunity to ask questions, that the benefits, risks, and alternatives of telehealth have been explained to you, and that you consent to receive care via telehealth. You may withdraw your consent at any time, except to the extent that action has already been taken in reliance on it, by contacting support@vitalehealth.shop.
